General Terms and Conditions for the Transport of Goods by Transmed MON IKE
By handing over the shipment to Transmed MON IKE for transport and handling, the sender expressly declares that they unconditionally accept the terms and conditions set forth below, and no agent, employee, or representative of Transmed MON IKE, nor the sender, has the right to waive or modify these terms.
ARTICLE 1: Transmed MON IKE undertakes the prompt and secure handling and delivery of documents, small parcels, and other items, in accordance with the provisions of its price list as in effect at any given time. The customer (sender) warrants that they are the owner of the items handed over for shipment and handling, or the representative of the owner of said items.
ARTICLE 2: The customer (shipper) guarantees that: A. The items are properly packaged. If their contents are damaged during handling because the packaging was inadequate, this precludes any claim for compensation. B: The details and full addresses of the sender and recipient have been correctly provided for the item being shipped.
ARTICLE 3: Gold, silver, precious stones, and precious metals in general cannot be shipped as ordinary items. For the shipment of these items, Transmed MON IKE offers special insurance in accordance with the terms and conditions of Article 9 below.
ARTICLE 4: Transmed MON IKE does not handle the shipment or transport of the following documents and items: Flammable, explosive, or corrosive substances; compressed gases; narcotics; poisons; cash; foreign currency; gold bars; industrial diamonds; postage stamps – antiquities – perishable foodstuffs – animals – plants – material of an indecent, obscene, or pornographic nature – items that, by their nature or packaging, pose a risk of damaging other items, the staff handling them or their equipment, as well as anything the company determines cannot be transported legally and safely. The customer (shipper) is liable for any damage that may result from the delivery for handling and shipment of such materials and substances with a false declaration of their contents.
ARTICLE 5: Transmed MON IKE has the right, but not the obligation, to inspect the item it receives for shipment and handling, as well as the right to open it. If it determines that the items delivered for shipment contain any of the prohibited materials or substances listed in Article 4, Transmed MON IKE shall refuse to accept and transport them.
ARTICLE 6: If, for any reason, delivery of the item to the recipient is not possible, the item will be returned to the sender within two (2) weeks of the date of receipt, subject to a fee equal to the shipping cost. If, upon return, the item cannot be delivered to the sender for any reason, it will remain at the offices of Transmed MON IKE for six months. After six months have elapsed, the item is deemed permanently undeliverable, and a destruction procedure is carried out, following the issuance of a relevant destruction report.
ARTICLE 7: Transmed MON IKE has the right to withhold or refuse delivery of any goods it transports in order to secure payment of any expenses arising from said transport [freight charges, customs duties, bills of lading, etc. ], until such expenses are paid in full.
ARTICLE 8: Transmed MON IKE undertakes to process shipments by charging its fee to the recipient. In the event that the recipient fails to pay the aforementioned fee for any reason, the shipper assumes the obligation to pay Transmed MON IKE.
ARTICLE 9: Insurance coverage for the shipment is the sender’s responsibility, particularly for shipments valued at over €150. In any other case of loss or damage attributable to Transmed MON IKE, its liability is determined in accordance with the limits set by the National Telecommunications and Post Commission. For coverage of larger amounts and for increased liability on the part of Transmed MON IKE, in excess of the specified amount (excluding coverage for the cases referred to in Article 11 below), a specific request from the shipper is required for additional insurance coverage, at the shipper’s own expense. Otherwise, the shipper assumes and accepts sole liability for all risks of loss, destruction, or damage. All international shipments are governed by the limitations of the Warsaw Convention and its amendments, as currently in force.
ARTICLE 10: A claim for compensation for an item that has been lost or damaged, or whose contents, in whole or in part, have been lost or damaged, must be submitted in writing to Transmed MON IKE, within six months of the date the item was handed over for shipment. In the event of a claim for compensation due to delayed delivery of the shipment, attributable solely to Transmed MON IKE, compensation shall consist of a refund of the full fee received for that delivery.
ARTICLE 11: Transmed MON IKE bears no liability and shall pay no compensation: For loss or damage caused by an error or omission on the part of the sender or the recipient. For loss or damage resulting from the nature or packaging of the item. For items whose shipment via Transmed MON IKE is prohibited [e.g., flammable materials, etc.]. For any direct or indirect, consequential, or special damages resulting from loss of income, profits, interest, sales, or use, breach of contract, etc. For loss or damage caused by delays or other hold-ups during the shipment of the items [e.g., due to an accident, adverse weather conditions, strikes, transportation delays, etc.]. For the payment of compensation when the claim for such compensation is not made in writing within the prescribed time limits.
ARTICLE 12: Any matter not provided for in the terms of this agreement shall be governed by the provisions in effect at the time for this specific contract. The courts of Athens shall have jurisdiction to resolve any dispute.
